They also explain the actions we may take in the event of non-compliance. By using our Services, you agree to abide by these Terms, as well as all other applicable policies and regulations, such as our Terms of Use and Privacy Policy, which are included in these Terms by reference. Notre générateur de sites web - Notre Service est un générateur de site web nouvelle génération qui nous permet de créer un site exceptionnel ou un véritable e-shop pour votre structure. Et devinez quoi ? Vous n’avez pas besoin d’être un pro pour l’utiliser ! Nous l’avons rendu super accessible et simple à utiliser. L’essentiel pour nous, c’est que vous vous amusiez en utilisant votre site, pour que vous puissiez concrétiser toutes vos ambitions associatives et rassembler vos membres, avec nous.

 

Processus de création Programme WOW - Nous avons établi une procédure simple qui vous permettra d’obtenir un site beau et fonctionnel dans le cadre du Programme WOW et que nous suivons pour faciliter les choses. Les étapes sont les suivantes :

Étape 1: Transmission des informations et contenus utiles à la création du site (vous venez avec ce que vous avez prévu avec impérativement du contenu textuel organisé).

Étape 2: Création du site à partir de la direction determinée avec la structure acccompagnée.

Étape 3: Retours et demandes portant sur la V1 en vu de la version finale du site web

 

Cette procédure vous permet de nous transmettre les éléments nécessaires à la création de votre site au bon moment. Elle nous permet d’être sûrs d’avoir toutes les indications et informations utiles et d’aller dans le sens de vos souhaits exprimés en relation avec les conseils de notre équipe. Dans le cas où vos demandes ne respecteraient pas la chronologie de cette procédure, nous pourrons bien sûr prendre en compte vos demandes en adéquation avec ce processus. 

 

Vos retours et demandes limitées de modifications - Ordinairement et pour le bon fonctionnement du Programme WOW, nous acceptons 1 cycle de révision mineures à partir de la version 1 du site que nous vous proposons. Nous vous demandons également de respecter un cadre précis lorsque vous nous transmettez vos retours et demandes afin de faciliter notre intervention. Nous pouvons aussi le faire en visio. 

 

Si vos retours et demandes ne respectent pas ce cadre, nous pourrons les refuser. Si vos retours et demandes dépassent ce cadre, nous pourrons vous proposer un surplus et une intervention hors Programme WOW, car une intervention trop lourde risquerait de porter préjudice à notre accompagnement auprès de l’ensemble de la communauté (pour des questions de temps essentiellement).

 

Modifications majeures après la V1 - Dans certains cas, vous pouvez peut exprimer de nouvelles attentes après la soumission d’une version de son site. Lorsque ces attentes impliquent des changements significatifs qui s’éloignent du cadre initialement défini, nous pouvons proposer des ajustements spécifiques, comme une refonte visuelle, une nouvelle identité graphique, des modifications structurelles ou tout autre élément modifiant la direction initiale du projet

 

Si vous bénéficiez bénéficie de ces travaux sans engagement de contribution raisonnable et cohérente, What The Web se réserve le droit de ne pas poursuivre la collaboration ou d’adapter son niveau d’accompagnement à l’avenir afin de préserver l’équilibre et la viabilité de son modèle basée sur le prix libre.

 

Toujours en amélioration - Chez What The Web, nous sommes en constante évolution. Notre Site et nos Services sont livrés en l'état, et nous prenons en compte vos retours pour les rendre meilleurs. CREATE AN ACCOUNT

To take full advantage of some of our Services, you'll need to create an account, but don't worry, it's quick and easy.

 

Creating an account - To access some of our Services, all you need to do is create an account (an "Account"). We'll ask you to provide specific information when you create it, and please agree to keep it up to date as necessary. Your Account is your personal space, and you're responsible for all activities that take place there, so keep an eye on your Account and related information for safe use.

 

We care about your safety - To ensure the safety of our platform and our community, we reserve the right to refuse to create an Account or to terminate an existing Account if it does not comply with our Terms. We are here to provide a safe and enjoyable experience for everyone.

SUBSCRIPTION

Chargeable Services - We have certain services that require payment, but don't worry, we'll always clearly inform you of the charges involved.

 

Payment of Fees and Subscriptions - Our Services may have to be paid for in advance. For example, if you choose a subscription to access the website manager, you will pay the corresponding fees according to the offers and conditions available on our page(https://www.whattheweb.org/). Everything will be in euros, unless otherwise indicated.

 

Payment solution - To facilitate payments, we use the payment solution provided by Stripe. You can pay your fees securely via this interface. By using our Services and accepting our Terms, you also accept Stripe's terms of use.

 

Taxes - In addition to fees, there may be taxes (such as VAT or other sales taxes). You are responsible for paying these taxes. Any application of or increase in VAT will be applied immediately to the fees for paid Services.  

 

Changes - If we make any changes to fees or payment terms, we will notify you in advance. Changes will apply to your future use, unless otherwise specified. You always have the option to cancel the Paid Service if you do not agree to the changes.

 

Automatic renewal - Some of our paid services are subject to automatic renewal to avoid interruptions. But don't worry, we'll let you know in advance if this applies to your subscription. You can manage automatic renewal in your profile at any time.

 

Refunds - Our paid services are non-refundable.

 

 

YOUR INTELLECTUAL PROPERTY

Your content belongs to you - You are the creator of your content, and we fully respect your rights. You own and retain all rights to the content you upload via our Services, whether images, videos, text or any other element (referred to as "Content" or "your content"). We do not claim any intellectual property rights to your content, and you are free to use it as you see fit, even outside our Site.

 

You give us permission to publish your site on whattheweb.org - We're proud of your work, and we'd like to show it off! When you upload content via our Services, you give us permission to publish and publicly display your site on the What The Web website. This means we'll be able to showcase your site and its content on our showcase pages. It's a great opportunity to showcase yourself and your talent to our community.

 

Feedback and suggestions - We love to hear your feedback and suggestions! If you have any comments or ideas about our Accompaniment, we'd love to hear from you. By providing us with suggestions or comments, you give us permission to use them to promote our Accompaniment. Your feedback is valuable and helps us to continually improve our Services.

This license allows you to create your own site, promote your activities and share your content dynamically and effectively. By using our Services, you join a community that values creativity and innovation. Our Services are protected by intellectual property and trade secret laws, which not only guarantee their superior quality but also ensure that they remain at the cutting edge of technology.

 

Your Use of What The Web - The license we grant you is non-exclusive, meaning that you benefit from the same cutting-edge tools as other users. This license is specifically designed to enable you to use our Services in accordance with our Terms, while giving you the freedom to use them to develop your online presence and expand your audience.

Our Templates - We may use Templates that are our property and we hold the associated intellectual property rights.

 

Export - We would also like to inform you that your site is not automatically exportable to other platforms, but if you need to, you can send us the website data on request for a specific fee. 

YOUR RESPONSIBILITIES

Your activities are your responsibility - We entrust you with the management of your site, and you are the master on board! The activities you carry out, such as selling products or services, are entirely your responsibility. Make sure you don't sell products that are prohibited or harmful to our reputation. You are responsible for everything that happens on your site and for the transactions you carry out.

 

Respect all our Terms - For the best possible experience, please read and follow our Terms of Use, which are there to protect us both and ensure the smooth operation of our Services.

 

Comply with regulations - It's important to comply with all applicable laws and regulations, including those relating to intellectual property, consumer protection and trade. We're not legal experts, but we rely on you to comply with these rules when using our Services.

Your site and your end-users - Your site attracts visitors and customers, and it's up to you to manage them. We're not involved in your relationship with your end-users - always be respectful of them, and make sure you respect any contracts you enter into with them.

 

age - We want everyone to benefit from our Services in an appropriate manner, so please ensure that you are of the right age in your country to use our Services, or that you have obtained your parents' permission if necessary.

YOUR COMMITMENTS

To keep What The Web a peaceful place for everyone, you agree to use our Services respectfully and within the framework set by our Terms.

 

Use the Site and our Services responsibly - You agree not to abuse the Services or assist anyone else in doing so. In particular, you agree to:

  • disrupt the Site or our Services, its users or the networks by, for example, distributing malicious software or overloading the  Services;
  • upload, collect or otherwise make available via the Site or Services any malicious, illegal, defamatory or obscene content ;
  • collect or post credit card or other financial information used to collect payments ;
  • act in a way that could damage What The Web's interests or reputation;
  • mislead or impersonate any person ;
  • engage in any inappropriate or illegal behavior, threaten, harass or abuse or incite violence;
  • in general, behave in accordance with all of our conditions, rules and charter applicable to the use of What The Web and our Services; 
  • inform us of the reasons for any decision to suspend your subscription. 

In addition, we expect the structures we support to respect this spirit, including in their dealings with our team and other What The Web users. This means adopting a courteous tone and formulating requests in a respectful manner, without harsh demands or inappropriate communication.

 

In addition, we rely on each structure to be well-informed about the framework of our support, by reading these General Terms of Service and the principles that govern our operation. This framework guarantees a harmonious experience for all structures supported, and enables everyone to take full advantage of the services offered.

 

Our actions - We reserve the right to assess the abusive nature of any behavior that is detrimental to the interests of the Site, our Services and the activities carried out on the Site. In the event that you have abused our Services and violated our Terms, we may take steps to suspend or cancel your Account and your Sites without any liability to you and without prior notice, at any time and for any reason and without refund (although we will endeavor to notify you before taking any such action).

Unlike a traditional service provision, our support is based on a relationship of collaboration and exchange, respecting the resources and framework defined for each project.

 

Based on free pricing, our model and our operations imply a mutual commitment founded on trust and reciprocity.  This is not a customer-supplier relationship with a strict obligation to achieve results, but rather a project built together, according to the needs expressed and the means available.

 

We do everything in our power to offer a quality service, while guaranteeing a balanced framework for all the structures we work with. In this sense, we reserve the right to refuse or interrupt a collaboration if it does not correspond to this spirit, particularly in the case of excessive demands, expectations incompatible with our operation or non-recognition of the work accomplished.

YOUR E-SHOP

You're about to embark on an exciting adventure with your e-shop! You can use your site as a real online sales space, but remember, you're in charge!

 

Your e-shop business is your responsibility - Our Services offer you incredible functionality to provide and sell products or services to your end-users, through your e-shop. However, you are solely responsible for everything that happens in your e-shop, including its content. Make sure you comply with all legal and tax obligations related to your business. The delivery of your products or services and any promises you make to your customers are also your responsibility.

 

Integrated payment solution - When your customers place orders via your e-shop, payments are processed by a third-party payment service provider. This provider is governed by its own Terms of Use, which you should read carefully before publishing your site or accepting payments. Please bear in mind that we are not responsible for your relationship with this payment service provider. You acknowledge and agree that this payment service provider will be the default provider for transactions on your e-shop.

THIRD-PARTY SERVICES AND CONTENT

We're pleased to offer you a world of possibilities with What The Web, including access to third-party services that can enrich your experience. Here's what you need to know about them:

 

Third-party services - On What The Web, you may find services offered by third parties, such as domain name subscriptions or products sold by e-shops created with our Services. These third-party services are governed by their own terms and conditions, and we are not responsible for those terms. You acknowledge that we act as  intermediary between you and these third-party services, but your use of them is your responsibility. When you access third-party sites via links on our Services, please note that you do so at your own risk.

 

Fees for third-party services - Some third-party services may require additional payments over and above our own Services. We will inform you of the terms applicable to these third-party services during the purchase process, and you will be able to view their terms directly. It is important to check these terms, as we do not refund purchases made from third-party services.

 

Termination - We reserve the right to suspend, deactivate or terminate any third-party service offered on What The Web at any time, in which case we will not be liable for any consequences of such termination, including any loss of profits or revenue.

 

Content from Third-Party Services - By using our Services, you may be exposed to user-generated content from third-party services. We do not endorse such content and are not responsible for it. It is your responsibility to protect your computer and network from any user-generated content accessible via our Services or What The Web.

 

Domain Name - If you choose to take or manage a domain name through What The Web, you will be subject to the terms and conditions of the provider of that third-party service. You are also responsible for renewing your domain name. Any violation of the third-party service's terms regarding your domain name will be considered a breach of our own Terms.

 

We want your experience with What The Web to be as rewarding as possible, and we make every effort to offer you interesting opportunities. If you have any questions about third-party services or how to use them, please don't hesitate to contact us. FLOW AND DISCHARGE

We understand that situations may arise in which payment is withheld or rejected, but it is important to note that withholding or rejecting payment in connection with our Pay Services may be considered a breach of your contractual obligations, in which case we may suspend or temporarily terminate your access to our services.

 

In such cases, we may have to temporarily suspend or terminate your access to our services. We will, of course, do our best to inform you of any such suspension or termination. However, where the opposition or cessation of payment is due to your initiative (for example, following a dispute notification received via our payment module), a reactivation fee of €150 will apply to restore access to our services.

 

Your access can be reactivated as soon as :

- The payment dispute or rejection has been cleared with your bank, allowing the initial debit to be made.

- Any outstanding charges, as well as the €150 reactivation fee, have been paid.

 

 

Finally, we reserve the right to contest any payment objection by providing the necessary proof that you have authorized the transaction and used the services in question.

EXCLUSION OF WARRANTIES

It is crucial to understand how our Services work. They are provided "as is" and unfortunately we cannot provide any specific guarantees. As for your content, we do not act as a publisher and are therefore not responsible for it. There are risks involved in using our Services, and it is important that you are aware of these risks and are prepared to assume them.

 

Our What The Web Services are made available to you "as is" and we want you to understand clearly that we cannot guarantee that they will meet your needs perfectly, that they will operate without interruption or that they will be completely secure and error-free. And while we strive to provide accurate information, we cannot guarantee that all information you obtain will be completely reliable.

It is also important to note that What The Web does not endorse any third-party products, entities or services mentioned or available through our Services.

 

With respect to user-generated content, we cannot be considered a "publisher" of such content, and we do not endorse or take responsibility for any content uploaded, posted, published or otherwise made available by any user.  

 

Please be aware that What The Web is a constantly evolving service, and we reserve the right to modify our services at any time. At times, this may mean changing or removing certain features or functions from our service. We strive to provide reasonable notice whenever possible.

 

Finally, What The Web and its affiliates, agents and officers specifically disclaim all of the above warranties, as well as any other warranties

LIMIT OF LIABILITY

Our limitation of liability in connection with your use of our Services.

As part of its support mission, What The Web takes great care to ensure the quality of its services.

In the event of difficulties arising from its services, What The Web may be held liable up to the amount actually paid by the beneficiary structure over the previous twelve (12) months. Where no payment has been made, this ceiling is set at a flat rate of fifty (50) euros. What The Web may not be held liable for the indirect consequences of any malfunction.

 

Any claim or action arising from or related to your use of What The Web must be notified to What The Web without delay.

 

In general, you agree that your use of the Service is at your sole risk and remains your sole responsibility.

 

What The Web undertakes to use all necessary means to provide the best possible support to each structure, taking into account its needs, constraints and objectives.

This commitment relates to the quality of the support and tools offered, but does not extend to guarantees of external results such as search engine positioning, volume of visits to the site, or the commercial impact of a project.

These elements depend on numerous external factors, over which What The Web has no control.

COMPENSATION

This is obviously not desirable, but you agree to defend and indemnify us in any lawsuit arising from your actions or use of our Services. 

 

You agree to indemnify and hold What The Web, its successors and assigns, and their employees, agents, directors, officers  harmless from and against any and all liabilities, losses, damages, claims and expenses of any nature, arising out of or in connection with your content or violation of our Terms, or your use (or misuse) of the Service and any violation of any rights of a third party, including but not limited to copyright, property or privacy rights, any claim related to end users of your site, any violation by you of any law or regulation or the rights of a third party or any injury to its reputation, any claim by tax authorities in any country regarding activities related to your site, including but not limited to your sales and any other activity for which What The Web could be held jointly and severally liable.

We will give you reasonable notice of any of the above situations. If you or we terminate your account, you may lose all associated information, including all of your content. You should therefore make regular back-ups of any data you store via the Service.

PROTECTING YOUR USERS' PERSONAL DATA

If you process sensitive information about your end-users, you must guarantee the protection of their personal data.

 

In your dealings with your end-users via our Services, you are in a position to process data from these end-users and agree to be solely responsible for this. You undertake to comply with the laws relating to the protection of personal data, security and privacy and in particular that relating to the General Data Protection Regulation (RGPD).

 

Depending on your legislation, you may be required to provide your end users with a privacy policy via your site.

DURATION AND TERMINATION

We would now like to discuss situations where access to our Services may be interrupted or restricted.

 

Our terms and conditions will remain in effect until terminated, either by you or by us. You may decide to terminate the agreement at any time. Of course, we would like to avoid this, but it is important for you to know that we reserve the right to modify, suspend or terminate your use of all or part of the Services, or to limit or disable your access at any time, particularly if you fail to comply with our terms and conditions of service. For example, we may be forced to suspend or terminate your use of the Services if you violate these Terms or other terms referred to.

 

If you decide to delete your Account or your Content, please be aware that this may be final and irreversible. To delete your Account, you will need to individually delete your Content from the "edit" tab of your profile. Please note that we may keep backups of Content on our servers, and some of your Content may remain on our servers even after you have requested to delete it. Clauses relating to our intellectual property, warranty disclaimers, limitation of liability, indemnification, dispute resolution survive termination.

GENERAL PROVISIONS

Here is some additional information to consider. 

 

These Terms of Use represent the entire agreement between you and What The Web regarding the use of our Services.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be deemed invalid, but that will not invalidate these Terms as a whole.

 

It is also important to understand that waiving the right to enforce a particular provision of these Terms at one time does not mean that we waive our rights to enforce other provisions or the same provision at another time.

 

Finally, these Terms and your relationship with What The Web under these Terms are governed by French law, and you agree to submit any dispute arising out of these Terms to the exclusive jurisdiction of the French courts.
